Terms of Service

These terms govern your use of Everwhen — the website, the signed-in app, and the gift, invite, share, and QR-playback links it creates. By using Everwhen, you agree to them. If you don’t agree, please don’t use the service.
1. The service
Everwhen lets a purchaser set up a private storybook, invite a storyteller to answer prompts by voice or in writing, and turn those answers into AI-drafted story pages that can be reviewed, edited, shared with family, and exported as a print-ready PDF. Everwhen is a digital service: it does not include physical printing or shipping. What a purchase includes, and how it is delivered, is set out in section 9.
2. Accounts
You need an account to create or edit a storybook. Accounts are created by signing in with Google or with a one-time code sent to your email — there are no separate passwords to manage. You are responsible for keeping access to the email address or Google account tied to your Everwhen account secure, and for activity that happens under your account.
3. Roles on a storybook
A storybook can have members in different roles:
- Purchaser — set up or manages the gift, and controls sharing and access.
- Storyteller — the person telling the stories, answering prompts, and reviewing generated pages.
- Helper — invited to assist with a storybook, e.g. entering answers on the storyteller’s behalf.
- Viewer — has read-only access to a finished or in-progress storybook via a share link.
A person can hold more than one of these roles across different storybooks. The purchaser or an editor-level member controls who is invited and can remove access at any time.
4. Invite and share links
A helper invite link only grants access once the invited person signs in and accepts it. A read-only share link grants access to anyone who has the link, without requiring sign-in, until it is revoked or expires. If you generate a share link, you are responsible for sharing it only with people you intend to give access to the storybook.
5. Your content
You (or the storyteller on your storybook) own the answers, recordings, photos, and stories you submit. You grant Everwhen a worldwide, non-exclusive, royalty-free license to store, process, and display that content back to you and to the members you’ve given access to, and to send it to our AI and infrastructure providers, solely to operate the service described in these terms. This license ends when the content is deleted from the service, except for residual backup copies kept per our Privacy Policy. We do not use your content for advertising, and we do not sell it.
You’re responsible for making sure you have the right to submit any photo or recording you upload, including the consent of anyone identifiable in it, where required.
Everwhen’s own software, design, question prompts, page templates, and brand remain the property of Everwhen. These terms don’t grant you any rights in them beyond using the service.
6. AI-generated content
Story pages are drafted by an AI model from your transcribed or typed answers. AI drafts can occasionally misstate a detail, name, or date. We recommend reviewing generated pages before relying on them or printing them, and Everwhen is not responsible for inaccuracies in AI-generated text that a review would have caught.
7. QR codes and audio links
We aim to keep QR/audio playback links working for as long as the service operates, but we do not guarantee permanent or lifetime access to any specific link, and access can be lost if a link is later revoked, an account is deleted, or the service is discontinued.
8. Acceptable use
You agree not to use Everwhen to:
- upload content you don’t have the right to share;
- attempt to access another user’s storybook without authorization;
- interfere with or disrupt the service, its infrastructure, or other users’ access to it;
- use the service for any unlawful purpose or to store content that is unlawful in your jurisdiction.
9. What you are buying, and how it is delivered
Everwhen sells digital storybook access: a one-time purchase that creates a private storybook with its question prompts, unlimited voice and written answers, AI-drafted story pages, photo uploads, audio playback links, helper and viewer sharing, and a print-ready PDF export. Physical printing and shipping are not included, and no physical product is sent to you.
Delivery is digital and immediate. As soon as your payment is confirmed, the storybook is created in your account and a confirmation email is sent to the address used at checkout — there is nothing to ship and no waiting period. If you bought Everwhen as a gift, you receive a private activation link to pass to the person the storybook is for.
The purchase is a one-time charge, not a subscription. Nothing recurring is set up, and you will not be billed again.
10. Payment and billing
Purchases are processed by Lemon Squeezy, which acts as the merchant of record for all Everwhen orders. This means Lemon Squeezy — not Everwhen — sells the product to you as a reseller, handles the payment, and collects and remits any applicable VAT or sales tax. Your card statement and receipt will show Lemon Squeezy, and your purchase is also subject to Lemon Squeezy’s own terms.
The price is shown before you pay, in US dollars, and is inclusive of applicable tax. Card details are entered on Lemon Squeezy’s hosted checkout and are never stored by Everwhen — see our Privacy Policy.
11. Refunds
Refunds are governed by our Refund Policy, which sets a 30-day refund window. Refund requests are handled by Everwhen support and processed back to your original payment method through Lemon Squeezy.
12. Service availability
Everwhen is an early-stage product. We aim to keep the service reliable, but we don’t guarantee uninterrupted or error-free availability, and features may change as the product develops.
13. Termination
You may stop using Everwhen and request deletion of your account at any time by contacting hello@everwhen.app. We may suspend or terminate access to an account that violates these terms or the acceptable-use section above.
14. Limitation of liability
To the maximum extent permitted by law, Everwhen is provided “as is,” and Everwhen is not liable for indirect, incidental, or consequential damages arising from your use of the service, including loss of content. To the same extent, our total liability for claims relating to the service is limited to the amount you paid us in the twelve months before the claim arose. Nothing in these terms limits liability that cannot be limited under applicable law, including consumer rights that apply in your country of residence.
15. Governing law
These terms are governed by the laws of Poland. If you are a consumer in the EU or UK, this choice of law does not deprive you of the protection of mandatory consumer-law provisions of the country where you live, and you may bring proceedings in your local courts where the law allows it.
16. Changes to these terms
We may update these terms as the product changes. We’ll update the “last updated” date above when we do, and material changes will be communicated through the app or by email where practical.
